ARTICLE ONE - Champ aPPLICATION

The online store "Cultureindoor.com" has been created and is operated by the company C.I.S.
The present General Terms and Conditions of Sale apply, without restriction or reserve, to all sales concluded by the company C.I.S. with non-professional buyers, wishing to acquire the products offered for sale by the Seller on its website Cultureindoor.com.
These conditions apply to the exclusion of all other conditions, and in particular those applicable to in-store sales or sales via other distribution and marketing channels.
These General Terms and Conditions of Sale are accessible at all times on this website and will prevail, where applicable, over any other version or any other contradictory document.
Unless proven otherwise, the data recorded by C.I.S constitutes proof of all transactions.
In accordance with Article L.111-1 of the French Consumer Code, the content of "Cultureindoor.com" enables the customer to know the essential characteristics of the selected product(s) before placing an order.

Product offers are subject to availability. Information on product availability is provided at the time the order is placed.
Modifications to these General Terms and Conditions of Sale are enforceable against users of the site from the time they are placed online, and cannot be applied to transactions concluded previously.

Validation of the order by the purchaser implies unreserved acceptance of these General Terms and Conditions of Sale.

ARTICLE 2 - Right of withdrawal

In accordance with the provisions of article L 121-21 of the French Consumer Code, the purchaser has a period of 14 working days from delivery of the products to inform C.I.S of his or her intention to exercise the right of withdrawal. The buyer must then return the products to the Vendor for exchange or reimbursement, provided they are returned in their original packaging and in perfect condition within 14 days of informing C.I.S of his or her decision to withdraw. Damaged, soiled or incomplete items will not be refunded or exchanged. Return shipping costs are the sole responsibility of the Buyer. Products must be returned with the invoice. The exchange (subject to availability) or refund will be made within 14 working days of receipt by the Vendor of the items returned by the Buyer. Refunds will be made according to the original method of payment, by credit card or bank transfer.

For health reasons, products for oral use (such as chichas, puffs, etc.) cannot be returned or exchanged. Any product to be exchanged or refunded must be returned in its entirety (including accessories and instructions) and in its original packaging in perfect condition, by Colissimo Recommandé with insurance covering the market value of the returned products, to the following address: C.I.S - 32 Rue de la Regalle -77181 Courtry.

ARTICLE 3 - Order validation

It is the customer's responsibility to select the products he/she wishes to order on the site.

Any order form signed by the customer by "double-clicking" constitutes irrevocable acceptance, which may only be challenged in the cases exhaustively provided for in these general terms and conditions of sale, such as the right of retraction and out-of-stock situations.

In accordance with the French law of March 13, 2000 on electronic signatures, from the moment the customer registers his order or "double clicks" on any order form, the customer's order is considered to have been accepted with full knowledge of the facts and is irrevocable, as regards prices, volumes and quantities.

Acceptance of the order is subject to payment and collection of the order in full.

In the event of cancellation of the order by the Customer after its acceptance by the Service Provider, beyond the 14 days resulting from the right of withdrawal, for any reason whatsoever except force majeure, a sum corresponding to 10% of the total invoice will be retained by the Service Provider, by way of damages, in compensation for the loss thus suffered.

ARTICLE 4 - Prices

Products are supplied at the current prices shown on the site when the order is registered by the Vendor.
Prices are expressed in Euros and include VAT (all taxes), with the exception of deliveries to countries outside the European Union, where prices are expressed in Euros or in foreign currencies and exclude VAT.

These prices are firm and non-revisable during their period of validity, as indicated on the Vendor's website. They do not include processing, shipping, transport and delivery charges, which are invoiced in addition.
An electronic invoice is drawn up by the Vendor and sent to the customer at the e-mail address communicated to the Vendor by the customer.

C.I.S reserves the right to cancel any orders on which the prices would be erroneous following a computer bug, hacking, error of seizure or other internal or external malevolence with the company. C.I.S will be obliged to inform the customer, cancel the order and proceed to a refund if necessary. If you notice an error, please contact us by e-mail at contact@cultureindoor.com.

ARTICLE 5 - Terms of payment

The price is payable in full on the day the order is placed by the Buyer.

To pay for the order, C.I.S offers the purchaser various methods of payment as indicated on the order form, namely :

- Credit card with secure payment with Payplug for payments in Euro and Sogenactif for payments in foreign currencies.

- Secure credit card payment in 2x, 3x and 4x free of charge with Alma.
Payment in installments/deferred is available via our partner Alma. Payment security is ensured by Alma and its service providers. All payments are protected by 3D Secure.
Purchase amounts
P2X: Only purchases between €50 and €3,000 are eligible for payment with Alma.
P3X: Only purchases between €50 and €3,000 are eligible for payment with Alma.
P4X: Only purchases between €50 and €3,000 are eligible for payment with Alma.
By paying in instalments with Alma, the Customer does not pay any fees.
Alma is a tele-payment manager and issues an electronic certificate as proof of the amount and date of the transaction in accordance with the provisions of articles 1316 et seq. of the French Civil Code.
Termination: Any termination of the General Terms and Conditions between the Seller and the customer will result in the termination of the General Terms and Conditions between Alma and the customer.

- Bank transfer.

Credit card payments are debited at the time the order is placed.


Orders paid by bank transfer will only be processed on receipt of payment. Availability and dispatch times are recalculated from the date of receipt of payment.

C.I.S reserves the right to suspend all order processing and deliveries in the event of refusal to authorize payment by credit card by officially accredited organizations, refusal to authorize payment by cheque by the private cheque guarantee company chosen by C.I.S or in the event of non-payment.
In particular, C.I.S reserves the right to refuse to make a delivery or to honour an order from a customer who has not paid in full or in part for a previous order, or with whom a payment dispute is in progress.
C.I.S cannot be held responsible for any embezzlement or fraudulent use of any means of payment not detected by the verification procedure.
C.I.S retains full ownership of the products sold until full payment has been received for all sums due by the customer in connection with the order, including taxes and charges.
The transfer of ownership of a good purchased from C.I.S by the customer to a third party will not be assumed by C.I.S.
. Only the original purchaser of this good may claim access to the clauses of these general conditions of sale.

ARTICLE 6 - Immediate discount and loyalty discount

From the first purchase and for any order exceeding the following thresholds, the customer will benefit from an immediate discount:
- 5% discount from €149 purchase
- 7.5% discount from €349 purchase
- 10% discount from €750 purchase
- 15% discount from €1500 purchase
- 20% discount from €3000 purchase
The customer will also benefit from a loyalty discount. Order totals (excluding shipping costs) are cumulative and the customer will receive the discount corresponding to the level reached.
The customer will lose the discount if no order is placed for a period of one year.

Certain products are excluded from the immediate discount and the loyalty discount. These products are marked "not included in discounts". The complete discount system may be suspended at any time (in particular during catalog-wide promotions, sales periods, etc.)

Flash sale products are excluded from the immediate and loyalty discount system.

ARTICLE 7 - Shipping / Delivery

Shipping times depend on the type of payment chosen by the customer, and the order will only be prepared once payment has been received and cleared.

Products purchased by the Buyer will be dispatched within a maximum of 5 working days to the address indicated by the Buyer when placing his/her order on the website, subject to available stocks.
In the event of unavailability of an ordered product, notably due to our suppliers, the purchaser will be informed as soon as possible and will have the option of cancelling the order. The buyer will then have the choice of requesting either a refund, if applicable, of the sums paid within 15 days of their payment, or an exchange of a product of equivalent characteristics and price, if C.I.S. is able to procure it.
If an exchange is not possible, C.I.S reserves the right to cancel the customer's order and refund the sums paid.
Information on the availability of products being transmitted by our suppliers, the unavailability of the product would not engage the responsibility for C.I.S nor to open right to damages for the customer.
Except particular case or unavailability of one or more products, the ordered products will be delivered in only one time.
Deliveries are made by an independent carrier.
- For mainland France, Corsica and Monaco: 24hr delivery by Chronopost for orders weighing less than 50kg, 2 to 3 working days delivery by carrier for orders weighing more than 50kg
- For international orders: 5 to 7 working days delivery by Chonopost or Coliposte
- For overseas orders: 4 to 8 working days delivery by Coliposte
Delivery of heavy and bulky packages may be sent by carrier.
The Vendor undertakes to use its best efforts to deliver the products ordered by the Buyer within the time limits specified abovecisaforementioned deadlines. However, if the products ordered have not been delivered by the end of the period stipulated in the contract, the sale may be cancelled at the written request of the Buyer. The sums paid by the Buyer will then be returned to him without delay, to the exclusion of any compensation or deduction, in accordance with article L111-1 of the French Consumer Code.

In the event of a special request by the Buyer concerning the packaging or transport conditions of the products ordered, duly accepted in writing by the Vendor, the related costs will be subject to specific additional invoicing, on the basis of an estimate previously accepted in writing by the Buyer.

Products are delivered to the address indicated by the consumer on the order form.
The order will be delivered "on the sidewalk" to the entrance of your house or to the main door of the building.
The delivery person will not be able to assist you in handling the article

It is the customer's responsibility to check the completeness and accuracy of the information provided to C.I.S. C.I.S. cannot be held responsible for any input errors and the consequences in terms of late or incorrect delivery. In this context, all costs incurred for the reshipment of the order will be entirely at the customer's expense.
C.I.S cannot be held responsible for delays in delivery due to errors in address or telephone number communicated by the purchaser, or in cases of force majeure.
The customer is responsible for checking the condition of the packaging and the contents of the goods on delivery. Any anomaly concerning the delivery (damage, missing product compared to the delivery note, damaged package, broken products, etc.) must be indicated on the transport receipt in the form of "significant and complete handwritten reservations", accompanied by the customer's signature, in the presence of the delivery person. In the case of a parcel sent by La Poste, if the parcel arrives open or damaged, it is essential that the customer has the letter carrier or post office draw up a "spoliation report" (report 170) so that C.I.S can open an investigation and compensation procedure.
At the same time, the customer must confirm this anomaly by sending a registered letter with acknowledgement of receipt to the carrier within two (2) working days of the delivery date, setting out the aforementioned claims.
The customer must simultaneously notify C.I.S by sending a copy of this letter (with the original of the "spoliation report" if applicable) to : C.I.S 32 Rue de la Regalle 77181 COURTRY or by e-mail to sav@cultureindoor.com within two working days. Once this period has elapsed and if these formalities have not been complied with, no claim can be validly accepted by the Vendor.

Depending on the place of delivery and the value of the order, the customer may benefit from free delivery (details here: http://www.cultureindoor.com/content/12-livraison-gratuite). Certain products are not eligible for free delivery due to their weight. In these cases, a flat-rate charge per unit is invoiced to the customer when the order is placed (this information is indicated at the bottom of the description of the products concerned).

ARTICLE 8- Delivery errors - Non-conforming products - Product returns

The customer must notify C.I.S. within 48 hours of delivery of any claim of error in delivery and/or non-conformity of the products in question nature or quality with respect to the indications on the order form. Any claim made after this deadline will be rejected without possibility of appeal.

All complaints to C.I.S may be made:

- by telephone on 01 64 21 20 00 from Monday to Friday from 10:00 to 12:30 and from 14:30 to 16:00.
Any claim not made in accordance with the rules set out above and within the specified time limits will not be taken into account and will release C.I.S from any liability to the customer.

It is reminded that the customer benefits from the legal guarantee against hidden defects (art 1641 to 1649 of the Civil Code) and the legal guarantee of conformity (art L211-1 and following of the Consumer Code). The buyer has 2 years from the date of delivery to take action. Under the warranty of conformity, the buyer can choose between repair or replacement. When invoking the warranty against hidden defects, the purchaser may choose between rescission of the sale or a reduction in the sale price in accordance with article 1644 of the French Civil Code.


Any product to be exchanged or refunded must be returned within 14 working days of receipt of the return agreement to C.I.S in its entirety (including accessories and instructions) and in its original packaging in perfect condition, by Colissimo Recommandé with insurance covering the market value of the products returned, to the following address: C.I.S - 32 Rue de la Regalle -77181 Courtry. All returns must be notified in advance to C.I.S. Customer Service. The printed returns form must be enclosed in the parcel.
C.I.S. will reimburse shipping costs incurred by the customer (based on receipts and within the limit of the cost of a registered colissimo shipment), except in the event that the returned product does not correspond to the original declaration made by the customer on the return form.
If the above procedure is not followed, no claim for non-conformity or apparent defect of the products delivered will be accepted.

The exchange (subject to availability) or refund will be made within 14 working days of receipt by the Vendor of the items returned by the Buyer. Refunds will be made according to the original method of payment, by credit card or bank transfer.

Health, hygiene and cosmetic products (including sprays) which have been unsealed and/or used by the consumer cannot be returned for reasons of hygiene and health protection.

In all other cases, the return of the product will be the sole responsibility of the customer.

ARTICLE 9 - Transfer of ownership - Transfer of risks

The transfer of ownership of the Vendor's products to the Buyer will only take place after full payment of the price by the latter, regardless of the date of delivery of said products.

ARTICLE 10 - Seller's liability - Warranty

Products supplied by the Vendor benefit, in accordance with legal provisions,

- the legal guarantee of conformity,
- the legal guarantee against hidden defects resulting from a defect in material, design or manufacture affecting the products delivered and rendering them unfit for use,
- the Manufacturer's guarantee, depending on the products and brands concerned.
All warranties are excluded in the event of misuse, negligence or lack of maintenance on the part of the Buyer, as well as in the event of normal wear and tear, accident or force majeure, and the Seller's warranty is limited to the replacement or reimbursement of non-conforming or defective products.
In order to assert his rights, the Buyer must, under penalty of forfeiture of any action relating thereto, inform the Vendor in writing of the existence of the defects within a maximum period of 8 days from their discovery.
The Vendor will replace or have repaired any products or parts under warranty found to be defective.
The products sold on the website comply with the regulations in force in France. The Vendor may not be held liable in the event of non-compliance with the legislation of the country to which the products are delivered, which it is up to the Buyer to check.
The Buyer is solely responsible for the choice of products, their conservation and their use.
The Seller shall not be held responsible or liable for any delay or non-performance resulting from the occurrence of a case of force majeure as usually recognized by French jurisprudence.
All electrical equipment supplied in kit form must be connected by a qualified professional electrician. C.I.S cannot be held responsible for any failure to comply with these installation instructions.

As an essential condition of sale, it is reminded that the Buyer is solely responsible for the use of the Vendor's Products, their suitability for the use made of them and their destination. The Buyer shall refrain from any use of the Seller's Products which would be contrary to public order, to the provisions of the French Public Health Code, and more generally to the legal or regulatory provisions applicable under French and European law.

Article 11: Waste Electrical and Electronic Equipment (WEEE) and Extended Producer Responsibility (EPR).

A. Electrical and electronic equipment (EEE)
Electrical and electronic equipment (EEE) may contain hazardous substances, which have a potential effect on the environment and human health.
EEE at the end of its life must not be disposed of with unsorted waste.
Collection and take-back systems for used electrical and electronic equipment are available to users.

B. Eco-participation.
When you buy a new electrical or electronic appliance, you help finance the collection, reuse and recycling of old equipment by paying an "eco-participation". All EEE prices shown on the site include the eco-participation fee. The collection and recycling of end-of-life electrical appliances is managed by non-profit eco-organizations approved by the public authorities. The amount of the eco-participation is calculated by these eco-organizations on the basis of the price of the processing operations required for recycling.

C. WEEE collection.
When you buy a new electrical or electronic appliance, you can return your old one to us free of charge.
You can let us know that you wish to dispose of an old appliance before delivery, by simply calling our advisers on 01 64 21 20 00.
You can then return your old appliance to one of the group's stores Culture Indoor (/growshops-culture-indoor).
Please note: the old appliance returned must be equivalent to the one purchased, complete, clean, emptied and ready to be loaded by our delivery drivers.
No dangerous, sharp or broken appliances will be accepted.
If you do not wish to take advantage of our WEEE take-back service, please note that there are other collection solutions for recycling your appliance.

D. Unique Identifier
As part of its activity and in compliance with EPR regulations, CIS SAS contributes to several organizations in order to finance the collection and treatment of various types of waste generated by the products thus placed on the French market.
In accordance with the AGEC law of February 10, 2020, the identifiers for the channels concerned by the activity of CIS SAS activity are :

Article 12: Partial non-validation

If one or more stipulations of these general terms and conditions are held to be invalid or declared as such in application of a law, regulation or following a final decision by a competent court, the other stipulations will retain all their force and scope.

ARTICLE 13 - Data protection

Pursuant to the French Data Protection Act 78-17 of January 6, 1978, the Buyer is reminded that the personal data requested from him/her is necessary for the processing of his/her order and, in particular, for the preparation of invoices.

The processing of information communicated via the Vendor's site has been declared to the CNIL.
In accordance with national and European regulations in force, the Buyer has a permanent right of access, modification, rectification and opposition with regard to information concerning him/her.

ARTICLE 14 - Intellectual property

The content of the site is the property of the Vendor and its partners, and is protected by French and international laws relating to intellectual property.
Any total or partial reproduction of this content is strictly forbidden, and is liable to constitute an infringement of copyright.
In addition, C.I.S retains ownership of all intellectual property rights on studies, drawings, models, prototypes, etc., produced (even at the Customer's request) with a view to providing services to the Customer. The Customer shall therefore refrain from reproducing or exploiting the said studies, drawings, models, prototypes, etc., without the express, written and prior authorization of C.I.S, which may make such authorization conditional upon financial consideration.

ARTICLE 15 - Applicable law - Language

By express agreement between the parties, the present contract is governed by and subject to French law.

It is written in French. Should it be translated into one or more languages, only the French text will be deemed authentic in the event of a dispute.

ARTICLE 16 - Disputes

All disputes arising from the present contract, concerning its validity, interpretation, performance, termination, consequences and consequences thereof, shall be submitted to the competent courts under the conditions of common law.
In the event of a dispute with professionals and/or merchants, the competent commercial court shall be that of the location of C.I.S.'s registered office.

In accordance with the provisions of the French Consumer Code concerning the amicable settlement of disputes, CIS adheres to the FEVAD (Fédération du e-commerce et de la vente à distance) consumer ombudsman, whose contact details are as follows:

ARTICLE 17 - Acceptance by the Buyer

The fact that a natural person (or legal entity) places an order on the Vendor's website implies full and unreserved acceptance of these General Terms and Conditions of Sale, which is expressly acknowledged by the Buyer, who notably waives the right to invoke any contradictory document, which would be unenforceable against the Vendor.
